These Terms of Use ("Terms") govern your access to and use of StrataProtocol.org (the "Service"), operated by Florante Pascual. The Service publishes documentation for STRATA Protocol and provides member accounts and member-only implementation materials. By creating an account, signing in, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

These Terms incorporate by reference our Privacy Policy, Cookie Policy, Acceptable Use Policy, and — for paid membership — our Refund & Billing Policy.

1. Eligibility

You must be at least 16 years of age to create an account or use the member features of the Service. By creating an account, you represent that you meet this requirement and that the registration information you provide is accurate and complete.

2. The Service

StrataProtocol.org is a documentation portal for STRATA Protocol, a governed framework for structured, traceable, and repeatable AI-assisted software delivery. The Service offers:

• Public documentation of the framework, freely readable without an account.
• Member accounts across membership tiers (community, customer, and partner).
• Member-only implementation materials, including templates and prompts, available to qualifying tiers.

The Service is provided on a best-effort basis. We may add, change, or remove features at any time.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate registration information and to keep it current. Notify us promptly if you believe your account has been accessed without your authorization. We store your password only as a salted hash and never store or transmit your plaintext password.

4. Intellectual Property and License

The STRATA Protocol framework, the documentation, and all related content published on the Service are the intellectual property of Florante Pascual, protected by copyright and other applicable laws. Except where a page states otherwise, you may read and reference the public documentation for your own use with attribution.

Member-only materials — including templates, prompts, and implementation resources — are licensed to you for your personal and organizational use in building your own projects. This license does not permit you to redistribute, resell, sublicense, or publicly republish the member materials, in whole or in part. Sharing credentials or member materials to circumvent membership is prohibited.

5. Acceptable Use

Your use of the Service is subject to our Acceptable Use Policy, which defines prohibited conduct and the enforcement actions we may take. Violations may result in suspension or termination of your account.

6. Membership and Billing

Some membership tiers are or will be offered on a paid basis. Where paid membership applies, the Refund & Billing Policy governs billing cycles, refunds, cancellation, and pricing changes. Nothing in these Terms obligates us to offer any particular tier or feature on a continuing basis.

7. Disclaimers

The Service and all member materials are provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, and we offer no service-level agreement. STRATA Protocol is a methodology; you are responsible for how you apply it and for the outcomes of your own projects.

8. Limitation of Liability

To the maximum extent permitted by law, Florante Pascual will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or profits, arising out of or related to your use of the Service. Our total aggregate liability for any claim arising out of or related to the Service will not exceed USD $100.

9. Indemnification

You agree to indemnify and hold harmless Florante Pascual from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your infringement of any third-party right.

10. Termination and Suspension

You may stop using the Service and request deletion of your account at any time. We may suspend or terminate your access if you violate these Terms or the Acceptable Use Policy, or where required to protect the Service or other users. On termination, your right to use the member materials ends. Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and indemnification — survive.

11. Changes to These Terms

We may update these Terms from time to time. When we make a material change, we will revise the effective date above and publish the updated Terms on this page. Your continued use of the Service after a change takes effect constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of Ontario, Canada, without regard to its conflict-of-laws principles. You agree to the exclusive jurisdiction of the courts located in Ontario, Canada for any dispute arising out of or related to these Terms or the Service.

13. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

14. Waiver

Our failure to enforce any provision of these Terms is not a waiver of our right to do so later. A waiver is effective only if it is in writing and signed by an authorized representative of Florante Pascual.
